STANDARD OPERATING PROCEDURE

PURPOSE

WWW.CNICA-ODR.COM is a web portal created for the purpose of resolving arbitration disputes online at the convenience of the parties and after providing the parties full opportunity to substantiate their case and have their disputes resolved in a most economical and speedy manner.

SCOPE

www.cnica-odr.com offers an online process to resolve disputes which are arbitrable under Arbitration and Conciliation Act 1996 with specific reference to section 29B of the Arbitration and Conciliation Act 1996. CNICA-ODR Rules has formulated two options for the disputants to resolve arbitration disputes online.

i) Disputes arising from the agreement where the parties have agreed to resolve their disputes through CNICA-ODR.COM platform.

ii) Disputes arising from the agreement where the parties have agreed to resolve their disputes by arbitration and have the required contact details to conduct arbitration CNICA-ODR.COM platform.

STEP BY STEP PROCEDURE

For the ease of understanding the flow of resolving arbitration disputes through the www.cnica-odr.com effort has been taken to provide a step by step guide to the disputants from commencing the arbitration procedure and completing the same.

The process is explained in three perspectives namely

1) Claimant

2) Respondent

3) Arbitrator

REGISTRATION PROCESS

➢ A new user requires to register. Click on “New User Register Here” A sign up form will appear and the registrant is required to fill in the form and click “Finish” to submit.

➢ Email will be received and click on the “Activation”

➢ OTP will be sent to the mobile number provided and the same would have to be entered and submitted.

➢ Login page will appear with registrant’s Name, Email ID and Mobile No. Password has to be entered into and submitted.

➢ This completes the New User Registration process. The Registrant there after may login using the user name and password.

NOTE: In case of respondent who has not registered in the platform earlier, the process is explained in detail below.

PROCESS FOR THE CLAIMANT

➢ Registration of New Claim

➢ Login as claimant – Case management page appears. For New claim click on the icon “+New Claim”

➢ Registration of Claim page appears.

➢ Fill in the form. Agreement with the arbitration clause to be uploaded. Reference letter sent to the Respondent to be uploaded and submitted.

➢ On Successful Registration of Claim the same will appear in the case management page.

➢ After the date has been fixed for filing the claim statement. The claimant shall login and view the case management page which will lead to the Case Docket page.

➢ In the claimant box for submitting claim statement the icon “Claim Statement” has to be clicked and that will lead to the page for filing claim statement.

➢ The Claimant can either fill in the form and submit or can upload the physical copy of Claim Statement and then submit. The Arbitrator’s fee and the administrative fees will be displayed that the payment gateway will be opened.

➢ On completion of payment the claim statement would be filled. The claimant there after can click on the icon “Upload documents” and upload document one by one providing the title of each document.

➢ Similar process shall be followed for filing Rejoinder and Arguments.

PROCESS FOR THE RESPONDENT

Where the Respondents’ email and mobile number are provided:

➢ In the email received by the Respondent, click on “Activate” and key in the OTP provided to complete new user registration. The login Id will be the email.

Where the Respondents’ mobile number alone in available:

➢ In the login page of www.cnica-odr.com page click on activate and entre OTP sent to the mobile, to complete new user registration. The login Id will be the mobile number.

If already registered, login

➢ On login, the case management page would be found. In the case management page click “view” to reach the Case Docket page.

➢ In the Case Docket page in the respondent box click on Statement of Defence.

➢ The Respondent can either fill in the form and submit or can upload the physical copy of Statement of Defence and then submit. The Arbitrator’s fee and the administrative fees will be displayed and on submission it will lead to the payment gateway.

➢ On completion of payment the Statement of Defence would be filled. The Respondent there after can click on the icon “Upload documents” and upload document one by one providing the title of each document.

➢ Similar process shall be followed for filing Reply to Rejoinder and Arguments.

PROCESS FOR THE ARBITRATOR

➢ After Registering as new User the Learned Arbitrator will have to Login and visit the case management page.

➢ In the case management page the Learned Arbitrator has to click on “View” to enter the docket page of the cases listed in the case management page.

➢ In the docket page in the Arbitrator section click on “Reply to Appointment”.

➢ The page for submitting consent and disclosure statement will appear. The Learned arbitrator can either fill in the form and submit or can upload the physical copy of statement and then submit.

➢For passing interim orders, final orders and Award the respective Icon can be clicked and the same can be uploaded.
